Terms and Conditions of Sale – Examera.org

1. Purpose

These Terms and Conditions of Sale (hereinafter referred to as the “Terms”) govern the sale, access, and use of the services provided on the website examera.org (hereinafter the “Site”), operated by Examera.

The Site provides, among other things:

  • project management exam simulators,

  • timed practice tests,

  • performance analytics and evaluation reports.

By registering for and/or using the Services in any manner, including but not limited to visiting or browsing the Site, you agree to these Terms (including the Privacy Policy and, where applicable, the EU Data Processing Addendum), as well as all operating rules, policies, and procedures that may be published from time to time on the Site by Examera, each of which is incorporated by reference and may be updated without prior notice.


2. Contact

All communication with Examera is carried out exclusively through the chat function available on examera.org.
No support is provided by email, phone, or postal mail.


3. Services and Access

  • Access to simulators and related services is granted upon confirmation of payment.

  • User accounts are strictly personal. Login credentials must not be shared, transferred, or sold.

  • Examera reserves the right to suspend or terminate any account found to be in breach of these Terms.


4. Orders and Payment

  • Prices are displayed in US dollars ($), inclusive of applicable taxes, unless otherwise stated.

  • Payment is made online via secure third-party payment providers.

  • Orders are considered final upon payment confirmation.

  • Examera reserves the right to modify pricing at any time, it being understood that the price applied is the one in force at the time of purchase.


5. Right of Withdrawal – Digital Content

5.1 General Rule

In accordance with Directive 2011/83/EU on consumer rights, consumers have a 14-day right of withdrawal for any distance contract (including online purchases). During this period, the consumer may request a refund without providing justification.

5.2 Exception for Digital Content

Pursuant to Article 16(m) of the Directive, the right of withdrawal does not apply to:

“The supply of digital content which is not supplied on a tangible medium if the performance has begun with the consumer’s prior express consent and with the acknowledgement that he thereby loses his right of withdrawal.”

5.3 Application to Examera

  • By purchasing and accessing simulation services on the Site, the customer:

    • provides express consent to the immediate provision of the digital content, and

    • acknowledges that the right of withdrawal is waived.

  • Consequently, all digital simulation services are strictly non-refundable once access has begun.


6. User Responsibilities

Users agree to:

  • Use the platform solely for personal training purposes.

  • Provide accurate registration and billing information.

  • Refrain from attempting to copy, resell, or redistribute the content or simulation tools.

  • Respect intellectual property rights as defined below.


7. Intellectual Property

  • All content made available on the Site (questions, simulations, reports, design, trademarks, logos, source code) is the exclusive property of Examera or its licensors.

  • Any reproduction, distribution, modification, or commercial exploitation without prior written authorization is strictly prohibited.


8. Liability and Availability

  • Examera makes every reasonable effort to ensure continuous access to its services.

  • However, temporary interruptions may occur due to maintenance, technical issues, or force majeure events.

  • Examera shall not be held liable for indirect damages, such as loss of data, profits, or business opportunities resulting from use of the Site.


9. Personal Data

The collection and processing of personal data are governed by Examera’s Privacy Policy, available on the Site.


10. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with French law.
In the event of a dispute relating to their interpretation or execution, exclusive jurisdiction is granted to the competent courts of Paris, France.
